Last updated: 24 February 2026
These Terms and Conditions govern the use of this website and the purchase of products from Ella & Olivia London. Throughout the site, the terms “we”, “us”, and “our” refer to Ella & Olivia London. By accessing our website and/or purchasing from us, you agree to be bound by these Terms and Conditions, together with our Privacy Policy, Returns Policy, Shipping and Delivery Policy, Payment Policy, and Cookie Policy.
If you do not agree with any part of these Terms, you must not use our website.
1. ONLINE STORE TERMS
By placing an order, you confirm that you are at least 18 years old or have permission from a legal guardian.
You agree not to use our products for any illegal or unauthorised purpose and not to violate any applicable laws in your jurisdiction. You must not misuse this website, attempt to interfere with its security, introduce malicious code, or engage in any activity that disrupts its functionality.
We reserve the right to refuse service, cancel orders, restrict quantities, or suspend access to the website where reasonably necessary, including in cases of suspected fraud, abuse, breach of these Terms, or misuse of refund or dispute procedures.
2. CONTRACT FORMATION
The presentation of products on this website constitutes an invitation to treat and not a legally binding offer.
By placing an order, you are making an offer to purchase the selected products. A binding contract is formed only when we send you an order confirmation email expressly accepting your order.
We reserve the right to refuse or cancel any order prior to acceptance, including where payment authorisation fails, stock is unavailable, pricing errors occur, delivery restrictions apply, or fraudulent or suspicious activity is identified.
Orders may not be cancelled once processing or fulfilment has commenced, except where required by applicable consumer law. Your statutory cancellation rights are set out in our Returns Policy.
3. PRICING AND AVAILABILITY
All prices are displayed in GBP unless otherwise stated.
All prices include applicable United Kingdom Value Added Tax (VAT), unless otherwise stated.
Prices are subject to change at any time, but changes will not affect orders that have already been confirmed.
In the event of a pricing error, system error, or typographical mistake, we reserve the right to cancel the affected order and issue a full refund. We are not obliged to supply products at an incorrect price.
All products are subject to availability. In rare cases where an item becomes unavailable after purchase, we will inform you and provide a refund.
4. PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, images, and specifications are accurate and up to date. However, minor variations in colour, texture, design, or appearance may occur due to display settings, lighting, or manufacturing differences.
Product images are for illustrative purposes only.
5. SHIPPING AND DELIVERY
Information regarding processing times, delivery estimates, and shipping methods is set out in our Shipping and Delivery Policy, which forms part of these Terms.
Delivery timeframes provided at checkout are estimates only and do not constitute a guaranteed delivery date. Delays may occur due to customs procedures, courier disruptions, seasonal demand, or other circumstances beyond our reasonable control.
Where applicable, products may be shipped from international fulfilment partners.
Risk in the goods passes to you upon confirmed delivery to the address provided at checkout. Confirmation of delivery by the courier, including delivery to a nominated safe place or neighbour where requested, shall constitute proof of delivery.
We are not responsible for delivery delays or failed delivery resulting from incorrect, incomplete, or inaccurate address information provided by the customer.
6. IMPORT DUTIES AND TAXES
We are responsible for applicable VAT on orders shipped to the United Kingdom. Customers will not be charged additional import duties for standard UK deliveries unless explicitly stated at checkout.
7. PAYMENT
We accept payment via Shopify Payments and other Shopify-integrated providers as listed at checkout. Further details are available in our Payment Policy.
All transactions are subject to payment authorisation, fraud screening, identity verification, and security checks. We reserve the right to delay, refuse, or cancel any order where irregular, suspicious, or high-risk activity is detected.
Ownership of the goods shall not pass to you until full and cleared payment has been received. Until such time, title to the goods remains with us.
8. CHARGEBACKS, DISPUTES AND FRAUD PREVENTION
We actively monitor transactions to prevent fraud and abuse.
By placing an order, you agree that we may use order details, billing information, IP address data, device data, delivery confirmation records, tracking information, and customer communications as evidence in the event of a chargeback, payment dispute, or fraud investigation.
Where a chargeback or payment dispute is initiated without valid legal basis, we reserve the right to contest the dispute and provide relevant documentation to the payment provider.
We reserve the right to restrict or refuse future transactions where we reasonably suspect misuse of return, refund, or chargeback procedures.
Nothing in this section limits your statutory consumer rights.
9. RETURNS AND CANCELLATIONS
If you are a consumer in the United Kingdom, you have statutory rights under the Consumer Contracts Regulations 2013.
You may cancel your order within 14 days of receiving your goods in accordance with your legal rights. Full details of eligibility, conditions, and procedures are set out in our Returns Policy, which forms part of these Terms.
Returned goods must be handled only as necessary to establish their nature, characteristics, and functioning. We reserve the right to make lawful deductions from refunds where goods show signs of excessive handling beyond what is reasonably permitted under applicable consumer legislation.
Refunds will be processed in accordance with UK law and our Returns Policy.
10. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded.
To the maximum extent permitted by law, we shall not be liable for indirect or consequential losses, including loss of profit, revenue, business opportunity, or data.
Our total liability in respect of any claim arising from a purchase shall not exceed the total amount paid for the relevant product.
We are not liable for delays, losses, or damage caused by events beyond our reasonable control, including supply chain disruptions, customs delays, courier failures, natural disasters, or other force majeure events.

13. ELECTRONIC COMMUNICATION
By using this website, you agree that communications with us may take place electronically, including via email, and that such communication satisfies any legal requirement that communication be in writing.
14. TERMINATION
We reserve the right to suspend or terminate access to our website where these Terms are breached or where reasonably necessary for legal, security, or fraud prevention purposes.
Any rights or obligations accrued prior to termination shall survive termination.
15. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. However, nothing in this clause shall limit any mandatory consumer protection rights that you may have under the laws of your country of residence.
